Can Spam Legislation Reference
Email marketing is super powerful. Unfortunately, Many Internet
Marketers abused this privilege.. Spam was one of the fastest growing
industries online from 1999-2003. The US Federal Government has stepped
in and is working to end this.
As Legitimate Internet marketers ItsAllAboutTraffic.com
applauds the actions of the US Government. The new Can Spam Act of 2003
is a good thing for all. Legitimate marketers will see an increase response
from our marketing efforts, and the ones who have been ruining it for
us get heavily fined, or jailed.
The Link below will give you a copy of the new anti-spam
law that was signed by President. We have included a run down of this
law, advise on how to comply, and our legal disclaimers on this
page. We recommend you take the time to read this prior to using
your leads.
Here is a brief run down of the new law:
1) The law became effective Jan 1, 2004
2) Prohibits using or falsifying email header information.
3) Prohibits the use of open relay to "deceive or mislead
recipients" about the origin of a commercial email.
4) Prohibits "harvesting," "dictionary attacks"
and "spoofing."
5) Prohibits commercial email without an unsubscribe process.
Either a web link or return email address are acceptable for unsubscribing.
You have 10 business days to process removal requests.
6) Prohibits automated methods to sign up for free Web-based
email accounts. (Like Yahoo or Hotmail)
7) Prohibits registering for "5 or more" email
accounts or "2 or more domain names" with false information
and using them to send commercial e-mail messages.

8) Prohibits sending "sexually oriented material"
unless it includes a label to be created by the FTC. And, you don't have
to do that if it is opt in. (Violations punishable by up to five years
in prison and a $250,000 fine)
9) The FTC to produce a report on possible mandated subject
line labeling, such as ADV (required in CA) for advertising. As currently
drafted, the Can Spam Act requires UCE to carry such information identifying
it as an advertisement or solicitation but does not mandate any specific
language.
10) Organizations that send commercial email must include
a valid U.S. postal address or P.O box.
Legitimate Opt in Email Marketing is a powerful tool when it is done legally,
ethically, and correctly. Here is some advise to make sure you are compliant
with the laws.
1) Include your postal address in all marketing emails. (If you do not
already have one you may wish to register a DBA (Doing Business As...),
and get a business PO Box with this DBA.
2) Do research about the autoresponder service you are using to send emails.
Make sure your autoresponder have a
removal process that can be handled for you. In addition make sure you
will also be able to manually unsubscribe clients who request this from
you through email, telephone, or postal mail.

3) When designing your autoresponder messages
A) Design subject lines that are clear about the
content that is included in the message
B) We recommend starting the subject line with ADV:
(short for advertising).
C) Under no circumstances include adult content with
your messages.5 years imprisonment and $250,000 can be imposed on the
first offense.
4) Make sure your emails are sent from an email address you will check,
and make sure your email reference are set to receive income emails.
Note: Full email boxes will often lead to
you being accused as a spamer. Be sure you have a large email box
that can handle all of your incoming messages.
